BEWARE THE LATEST SALES BLOCKING TACTIC...

As some Park Owner abuses of their positions can quickly be adopted

by others, here`s the latest try-on. We`re not identifying the operator at this point - but if it continues – we will.


The site owner is advising residents with homes for sale, that there are Park Rules that say they can only sell to someone of their own age or older . None of the residents were previously aware of any such a Rule and which, in any event, is NOT permitted.


As a park home owner, you have an "unfettered right" to sell your home to a person of your choice (provided they meet PERMITTED site rules) without the permission of the site owner. 


As with any other attempts that constitute sales blocking, then the victim should document everything:  Gather all evidence of the site owner blocking the sale and make an urgent application to a First Tier Tribunal for a determination.


If the site owner is engaging in illegal sales blocking, the tribunal is the appropriate venue to enforce your rights.  Use and Submit Form PH3:  ( "Application. for a determination of any question arising under the Mobile Homes Act 1983".)


An urgent application should be made via email to the regional First-tier Tribunal office, marked clearly as "URGENT" in the subject line, with an explanation of why the matter is urgent.


What Constitutes Urgency:  The tribunal can expedite cases where the health, safety, and welfare of people are involved, or in situations of significant time-sensitive abuse , which sales blocking is likely to be . The tribunal can determine issues related to the transfer of ownership of a park home to someone else. 


IT IS A CRIMINAL OFFENCE for a site owner to prevent a sale, or to make false or misleading statements to try to prevent a sale.


You should report sales blocking to your local authority, which has the power to prosecute site owners. It`s also relevant to the Fit & Proper person criteria. If the Local authority tells you it`s a contractual matter and they cannot become involved contact the Leasehold Advisory Service for Park Homes.
