YES – YOU CAN CHALLENGE A PROPOSED PITCH FEE INCREASE IF THE AMENITY OF THE SITE HAS HAS GOT WORSE - OR NOT IMPROVED....

Sometimes, residents are led to believe ( including some tribunal judges ) that they cannot challenge a proposed pitch fee increase if the site has simply remained in the same poor condition as the previous year or years.

Below, you`ll find the question submitted by a Wykdcrest RA to the government sponsored Leasehold Advisory Service in August 2025 and which any resident who wishes to oppose a proposed pitvh fee increase can refer to if need be....


QUESTION TO LEASE

We won a First Tier Tribunal where the tribunal awarded a 20% deduction to the pitch fee being demanded by the park owner due to the deterioration and lack of maintenance of the park since taking over ownership of the park. The park owner appealed the decision but lost the appeal.


The following year the park owner applied to the tribunal to re-instate the 20% reduction, claiming the condition of the park had been fully restored, but following a hearing and park inspection by the tribunal, this was denied because there had been no improvement or restoration to the poor condition since the 20% reduction in pitch fee. The park owner appealed the tribunal's decision but the appeal was denied.My question is as follows:-Since there has been no improvement to, or re-instatement or the park conditions, which have in fact worsened, can we refuse to pay the upcoming CPI increase to the pitch fee but refer it to the First Tier Tribunal for determination?Many thanks,
